Résumé:
刑科題本是清代司法程序中主要文書之一。由巡撫擬定，奏給皇帝和抄送給刑部複核，也是中央行政機關裁判案件的重要依據。同時，刑科題本鏈接地方和中央審判程序的關鍵環節。本次报告通过寶坻、南部、巴縣檔案中的幾起包含地方和中央相對應文件人命案件對刑科題本和州縣司法文獻比較。通過这些文獻的閱讀，我们可以觀察刑科題本的擬定過程以及它们所包含的信息與地方檔案描述的案情之間的區別。最後，本報告論及移情就法策略出現的原因，以及當時官箴書在官員擬定司法文書的過程中的參考作用。
